Trump Administration Measures to Restrict Work Visas Thrown Out
The Department of Labor Called Out for Not Following Due Procedures
The Trump Administration’s restrictive measures on H-1B visas, through
the imposition of punitive salary requirements, were thrown out by a federal
district judge in California. The Administration’s disdain for and
lack of adherence to following regulatory process, including providing
for a period for public comments, were the reasons for a decision in favor
of the plaintiffs, who were seeking injunctive relief from the October
1, 2020 Department of Labor (DOL) measures.
It is difficult to foresee what the Trump Administration will do next –
accept the judgement and remove the onerous DOL measures or run out the
clock remaining of this administration by throwing up more roadblocks.
